Websiteservicesagreement.
What you agree to when you order a website online at loudlaunchdigital.com/start. Plain words, no tricks.
This agreement is between Loud Launch Digital, Calgary, Alberta ("we", "us") and the person or business placing the order ("you"). You accept it by ticking the box and typing your name at checkout. Your order details (package, pages, extras, domain and prices) are part of this agreement and are emailed to you after you pay.
1. What we're building
The package you picked: Launchpad (1 scrolling page), Liftoff (up to 5 designed pages) or Full Thrust (up to 8 designed pages), plus any extra pages, tool connections and add-ons on your order. Every site also gets a privacy policy, terms (if you sell anything), a thank-you page and a 404 page, which don't count as pages. Basic SEO means we set up your page titles, descriptions, headings and sitemap so search engines can read your site; it is not a promise of any ranking, and it doesn't include analytics, ads or Google Business Profile setup unless they are on your order. Anything not on your order is extra work at $50 an hour or a new quote, agreed in writing (email counts) before we start it.
2. How it works
Within 2 business days of checkout we review your order and the files you uploaded. If we need anything else (for Launchpad, that includes all page text), we'll email you. Please send it within 14 days; if we haven't received what we need 30 days after checkout, we may close the project, and your first payment covers the work done and isn't refunded. Next, we send you 3 design directions for your home page to choose from. Once you pick one and approve the design, we build the rest of the site, you review it, and we launch.
3. Changes
You get up to 3 rounds of changes before launch. A round is one list of changes sent together. Changes after that are $50 an hour, and we'll tell you before we start.
4. Timeline
We aim to launch in about 7 days (Launchpad), 2 to 3 weeks (Liftoff) or 3 to 4 weeks (Full Thrust) after we receive everything we need (section 2). Time spent waiting on you moves the date.
5. Payment
At checkout you pay 50% of the build price plus 100% of the domain (if we're registering one for you). At delivery, when your site goes live, we charge the remaining 50% plus your first month (or year) of Care. You authorize us to charge the card you used at checkout for the delivery payment and for Care renewals. If that charge doesn't go through, we'll email you a secure link to pay. Prices are in Canadian dollars.
6. Refunds
If you cancel before we start design, we refund your build payment. Once design has started, the first payment isn't refunded. Domain fees are never refunded once the domain is registered.
7. Your domain
If you order a new domain, we register it for one year and hold it in Loud Launch Digital's registrar account (Hostinger) on your behalf, so you don't have to manage it. It's yours: whenever you ask, including if you leave Care, we'll transfer it to you or to the registrar you choose, at no charge from us. Renewals are billed to you yearly at the registrar's price. If we can't register it (for example, someone else takes it first), we'll offer an alternative or refund the domain fee.
8. Care plan
Care is $29.99 a month (or $299 a year) from your launch date and renews automatically until you cancel. There is no minimum term. It covers hosting, SSL, backups, security, keeping your site and forms running, and up to 2 hours of edits a month (unused time doesn't roll over). Extra time is $30 an hour. Cancel anytime by email before your next renewal. Your site goes offline at the end of the paid period, and we'll send you a copy of your site files on request. If a renewal payment fails and isn't fixed within 14 days, we may take the site offline.
9. Who owns what
Once both build payments are made, you own your site's content and design. We keep the right to reuse our general code, layouts and know-how, and to show your site in our portfolio unless you ask us not to.
10. How your site is built (please read)
Your site is built in plain HTML, not WordPress, Wix or Squarespace. Tools that connect by code, embed or link (booking, payments, email lists, analytics, chat, reviews and similar) can be connected. Up to 2 are included, then $50 each. These don't carry over to your new site: WordPress plugins (for example WooCommerce, Elementor forms, membership or course plugins), features built into Wix or Squarespace (their stores, scheduling, member areas and blogs), and anything that needs logins, such as client portals, members-only content or online courses. You can't edit the site yourself. Changes go through your Care edits or our hourly rate.
11. Your responsibilities
You confirm you have the rights to everything you send us (text, photos, logos and other material). You're responsible for your business name and any trademark issues: we don't run trademark or clearance searches. You're responsible for your own privacy and anti-spam compliance (such as PIPEDA, Alberta PIPA and CASL). We provide a standard privacy policy for your site, but it isn't legal advice.
12. Limits
We'll do the work with reasonable care and skill. We aren't responsible for third-party services (such as Hostinger, Stripe or booking tools), outages outside our control, or lost business or profits. Our total responsibility under this agreement is limited to the amount you've paid us under it.
13. The rest
This agreement is governed by the laws of Alberta and the federal laws of Canada that apply there. If part of it can't be enforced, the rest still applies. Together with your order details, it's the whole agreement for this project, and changes must be in writing (email counts).
